The Koozer-Kuhn Tennessee Marijuana Legalization Bill

By Arline Bradley

Early this year, a new bill introduced by Sherry Jones, House Representative was placed on the calendar. This bill attempts to legalize cannabis and establish the beginning of what is hoped to be a Tennessee marijuana legalization program like those found in other states. The Koozer-Kuhn Medical Marijuana Act would legalize cannabis for medical use.

Supporters of the bill range widely from those who only support medical marijuana to others who opt for making the herb legal for personal use. There are also those who support legalization strictly for medical reasons. Whatever the outcome, it is important that the herb be taxed and regulated appropriately.

Other states recently supporting full legalization of cannabis have created an increased level of support for medical use, or at the very least decriminalization. This includes Texas, the first state to make the herb illegal just over one hundred years ago. A state where citizens were once able to purchase cannabis over the counter, or place an order by U. S. Mail.

While Texas may never see full legalization, it is progress that a bill has passed that allows officers to use "cite and release" measures based on those caught with up to less than four ounces. It is not okay that the law leaves discretion to local authorities as this can promote individual profiling. The main reason the governor gives for this new law is that he does not want to see young people become more severe criminals by going to jail.

Colorado and Washington, states which recently legalized marijuana for personal use have created a reality in which people across the nation are discussing the issue in public forums, meetings and online. Discussions which in the past could have lead to arrest on suspicion holding or using illegal drugs. This may still be the case in some areas though most feel if marijuana can be legalized in some states, it need be legalized in all.

There are now twenty one which have legalized marijuana for medical use. As Colorado and Washington are now seeing a surplus with regards to monetary standing, there is no doubt others will follow. As for Tennessee, Texas and other conservative areas, this remains to be seen.

Whether or not Tennessee creates a medical marijuana program is yet to be seen based on the outcome of this new bill. It is an ongoing belief that this bill has a better chance of passing than one wishing to fully legalize cannabis for personal use. There are also supporters on both sides which believe it should either be fully available to all citizens, or not at all.

There are many lawmakers in both liberal and conservative areas of the United States telling local citizens if it can be proven that medical cannabis cures or prevents disease, votes and views may change. In many areas, this alone is progress. As for Tennessee, only the House of Representatives, citizens and voters have the power to change current laws relating to legalization.

Tennessee may or may not follow Colorado and Washington with full legalization whereas other states are already working on language to pass similar bills. Medical cannabis definitely has a better chance, especially in Tennessee. Those suffering only hope State representatives will have mercy and pass this new bill allowing for growth and distribution on a medical basis.
